Man Who Raped 94-Year-Old Woman Gets 17 Years
After long search, extradition, Recendes admitted to raping, beating, 94-year-old woman
The man who raped and beat a 94-year-old woman more than eight years ago in the Palo Alto Commons got 17 years in state prison Thursday.
After admitting to the violent rape last October, Roberto Recendes, now 42, received eight years for forced penetration, four years for elder abuse and a five-year enhancement for inflicting great bodily harm. Recendes was also ordered by a Santa Clara County Superior Court Judge to pay $6,800 in restitution to the victim's family and $390 in mandatory court fines. Recendes is also required to register as a sex offender.
His plea bargain came after a long manhunt and a 2008 extradition to the United States by Mexican authorities.
Details of the crime were not immediately available, but Recendes Santa Clara County Public Defender Carl Beatty said he assaulted the now-deceased woman in the convalescent home on El Camino Way in May 2002.
"She was pretty bruised up," Beatty said after the trail, citing records and explaining how the court generated the five year enhancement.
Beatty was unsure when Recendes fled the country, but said the Mexican government returned him to California on August 13, 2008. Palo Alto police arrested him a few days later. Between his time served in Mexico and here, Recendes was credited 1,215 days served toward his final sentence.
Beatty also brought up the arrest of a teenage boy who falsely confessed to the crime. The charges were dropped before trial, Beatty said. He did not have further details.
