Simitian's Renters Protection Bill on Governor's Desk

The proposed law would protect prospective renters before they sign a rental agreement.


Renters are often the forgotten victims of foreclosure, being forced to move from their rental homes or condos through no fault of their own. They often lose security deposits, must endure moving expenses, and the stress of making an unplanned move.

State Senator Joe Simitian’s (D-Palo Alto) Senate Bill 1191 is now headed to Governor Jerry Brown’s desk. It would require that prospective tenants be warned when the property they are looking to rent is subject to foreclosure.

 Under existing law, a landlord is not required to disclose this fact to a prospective tenant. The vote in the Senate was 24-9.

“Tenants are often shocked to learn of pending foreclosure proceedings after they move into a new home,” said Dean Preston, executive director of Tenants Together, a statewide organization for renters’ rights. “Tenants need this information before they move in, so they can make an informed choice about where to live. We commend Senator Simitian for championing this important bill.”

The Governor has until September 30 to act on the measure.
